Active Military in NASA

A majority of astronauts came from the military, but are there any active military who have been in space? Are there are laws/charters that prevent that? I know it was a movie, but in The Martian, they mentioned that two of them are military, so they could be court marshaled (for mutiny. in this case). Assuming that they were active military, could they actually be court marshaled for any reason, since NASA is a non-military organization?

Secondly, is it even by definition, possible to commit mutiny on a spacecraft if the crew (commander included) agreed to a course of action? Is the commander in charge or is ground control? There was at least one instance where the crew "boycotted" NASA's decision and decided to take a rest from the duties.
